Terms of Service

These terms are an agreement between you and surfbaby.ai ("surfbaby", "we", "us") covering your use of our website and coaching-report service. By creating an account, submitting footage, or viewing a report, you agree to them. If you are using surfbaby on behalf of a coaching business, you agree on that business's behalf.

1. The service

surfbaby.ai produces written coaching reports from ride videos you submit for surf, wakesurf, and wakeboard riding. A report typically contains a verdict, a ride timeline, a scorecard, three priority fixes with marked-up frames, drills, and a printable cue card.

Reports are AI-drafted and human-reviewed. Our analysis engine drafts the report from your footage and your athlete history; a human reviews it before it is released to you. We may maintain an evolving athlete profile for each rider so later reports can reference earlier sessions.

Coach white-label flow. Where a coach submits footage for their students, the drafted report is delivered to that coach first. The coach reviews it and either releases it to the student under the coach's own brand, or requests changes. Nothing reaches the student until the coach approves it. A coach who releases a report is responsible for the coaching guidance they put their name on.

2. Accounts and roles

You need an account to submit footage or receive reports. Keep your credentials secure; you are responsible for activity under your account. Provide accurate information and keep it current.

There are three roles:

  • Rider — submits their own footage and receives their own reports and history.
  • Coach — maintains a roster of students, submits footage on their behalf, and reviews and releases reports under their own brand.
  • Admin — surfbaby staff who operate the review queue, accept or reject footage, and deliver finished reports.

Roles are granted by us. Coaches must have the authority to act for the students on their roster and must obtain the consents described in section 7.

3. Payment terms

Amounts below are configurable and may change; the price shown at the point of purchase is the price that applies.

  • Consumer: $25 USD per ride analysis, charged before submission.
  • Coach pilot / subscriptions: a founding coach pilot is offered at $99 USD, with recurring or volume plans introduced later on terms provided to the coach at sign-up.
  • Founding access: during launch we may waive fees entirely. Waived pricing is temporary and can end with notice.

Payments are handled by a third-party payment processor; we do not store your card details. Prices exclude any taxes or bank fees that may apply to you. Refunds are handled per our stated guarantee at the time of purchase and per section 4.

4. Turnaround and footage-rejection credits

Our target turnaround is 48 hours from an accepted submission to a delivered report. This is a target, not a guarantee; queue depth, footage length, and coach review time can extend it.

If we cannot read your footage, we reject it with a specific reason (for example: filmed too far away, rider not visible, portrait orientation, clip cut mid-ride, or quality too low) and issue you a credit for a future submission rather than producing a low-value report. Credits do not expire while your account is active and are not redeemable for cash unless required by law.

5. Assumption of risk

Surfing, wakesurfing, and wakeboarding are physical activities that carry an inherent risk of serious injury, drowning, or death. By using surfbaby you acknowledge these risks, confirm you participate voluntarily, and accept responsibility for your own safety and for assessing conditions, equipment, and your own ability before attempting anything.

Do not attempt a drill or manoeuvre suggested in a report if conditions, your fitness, your equipment, or supervision are not appropriate. Riders under 18 should train under the supervision of a responsible adult.

6. Informational, not professional advice

Reports, drills, cue cards, and any other output are informational only. They are not professional coaching, medical, physiotherapy, rescue, or safety advice, and they are not a substitute for in-person instruction or a qualified medical opinion. We are not your coach, trainer, or clinician.

If you have an injury, a medical condition, or any doubt about your fitness to ride, consult a qualified professional before following anything in a report.

7. Acceptable use

You may only submit footage you have the right to submit. Specifically, you agree that:

  • you own the footage or have permission from whoever filmed it;
  • every identifiable person in the footage has consented to being filmed and to that footage being submitted for coaching analysis;
  • for anyone under 18, a parent or legal guardian has given that consent, and the coach or rider submitting the footage is responsible for having obtained it;
  • you will not submit footage taken covertly, in a location where filming is prohibited, or in a private setting such as a changing area.

You also agree not to:

  • upload unlawful, harassing, or sexually explicit material;
  • attempt to access another user's athletes, sessions, videos, or reports;
  • probe, scrape, overload, or reverse-engineer the service;
  • resell reports as your own outside the coach white-label flow, or misrepresent an AI-drafted report as an unaided human assessment where that would mislead.

8. Your content and our content

You own your footage. Uploading it does not transfer ownership. You grant us a limited, non-exclusive licence to store, process, and analyse your footage strictly for the purpose of producing and delivering reports for that athlete, and to operate and secure the service.

We do not train AI models on your footage, and we do not sell it, license it to third parties, or use it for advertising. If we ever want to use a clip publicly — a marketing example, say — we will ask you first and you can say no.

Reports. We grant you a perpetual, non-exclusive licence to use, download, print, and share the reports produced for you, including sharing them with your own coach or athlete. Coaches may release reports to their students under their own brand. The underlying report format, templates, analysis methodology, and software remain ours.

Feedback you send us may be used freely to improve the service without obligation to you.

9. Suspension and termination

You can stop using surfbaby at any time and request deletion of your account and data (see the privacy policy). We may suspend or terminate an account that breaches these terms, that presents a legal or security risk, or where required by law — with notice where practical, immediately where not.

If we terminate your account without cause, we will refund any unused prepaid analyses or credits. Sections 5, 6, 8, 10, and 12 survive termination.

10. Disclaimers and limitation of liability

The service is provided "as is" and "as available". We do not warrant that reports will be accurate, complete, or suitable for your circumstances, that analysis will identify every fault in your riding, or that the service will be uninterrupted or error-free.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential loss, for loss of profits or data, or for injury or loss arising from your participation in a physical activity. Our total aggregate liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud or for death or personal injury caused by our negligence.

11. Changes to these terms

We may update these terms as the product changes. We will update the "last updated" date above and, for material changes, notify account holders by email or in-app. Continuing to use the service after a change takes effect means you accept the revised terms.

12. Governing law

Placeholder pending final legal review. These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over any dispute, without regard to conflict-of-laws rules. If you are a consumer, this does not deprive you of protections you have under the mandatory law of your home country.
